Default RFE from VSC for I-751 - Please help!

Hi everyone,

I was really disappointed to receive an RFE from VSC for I-751 that I had sent in mid-April.

It came in a 2 page blue form requesting further information. Do I need to worry about anything? Is it common to receive RFE's. I thought that most I-751 were approved without RFE's or interviews. I sent a lot of information with my application.

Form I-751 Removal of Conditions
Check for $205.00
Copy of my husband's passport
Copy of my Permanent Resident Card
Copy of our Marriage Certificate
Copies of joint utility bills
Copies of joint bank statements
Copy of joint mortgage
Copy of joint Income Tax Return for 2003
Copy of joint Income Tax Return for 2004
Copy of joint Health Insurance coverage
Copy of joint Car Insurance coverage
Copy of joint Home Insurance coverage
Copies of boarding passes of travel together
Two original letters written and notarized by our friends attesting to our relationship and marriage

Should I have included more? Please help!

If you wish to worry, please feel free to do so.

Is it common to receive RFE's.
It is not UNcommon.

I thought that most I-751 were approved without RFE's or interviews.
Most are

I sent a lot of information with my application.

No, not from my view point, at least.

You don't ask what in particular they asked for. Whatever it is, send it as instructed. If they are asking for additional evidence, it sounds as if you ~might~ be approved without an interview.

Hello Fun,

I am in the very same boat- had submitted everything on your list (apart from affidavits). Got the blue letter nonetheless- asking for more documents to prove our marriage was entered in good faith- almost all of the documents they list as examples had been submitted with the original application...

Now I will just scrap together everything else I can find (including tax transcripts from IRS). I will submit more bank statements, will get a life insurance, spam them with pictures and letters/emails that were sent to us as a couple. I'm even contemplating sending the kitchen sink (for fingerprints)They asked for it- they will get it...

I still believe that they lost part of my application...

Just follow the directions and send them what they asked for. Yes - even IF, you had already sent it - send it again. No big deal.

It's common to get RFE's. If you take a moment and do a search on the board, you'll see that this is true. You can also see how others have handled it.

Why worry - what purpose will it serve? Just concern yourself with what you DO have control over. Save any concern for more serious matters.

Send them what they asked for and relax and be done with it.

Hi:

The regulations give you three options in answering an RFE:

1) give them what they want;
2) given them part of what they want and request they adjudicate based upon the record; or
3) give them nothing, but request they adjudicate on what they have.

The one thing you canNOT do is ignore the thing.

I have sometimes responded by noting that the RFE is a request for a second copy of what we already provided, note that we are cognizant that the "contractors" lose things, express sympathy for their workloads,etc etc.

Thanks so much for responding. We filed for an extension for our 2005 taxes and that's why we have not sent it with the package. I guess we will hurry up and do it.

Also, my name was added to the mortgage but not filed with the county. They asked for paperwork filed in the county......what should I do?

It's a double edged sword - I sent everything so it will be plenty evidence and I won't get RFE's and now they are asking for more information and I don't have much additional information because I sent everything.

I will try not to worry......thanks everyone.....please give me any other suggestions you may have....I will also search this message board for ideas on what I could send.

File with the county.

ASAP.

Contact the county's office and ask if they can expedite.

I totally disagree. It's NOT a double edged sword - where do you get that from? the process is what it is. Seems what they're asking for is something you don't have due to you all not having it before you filed.

1. they can ask for almost anything, reasonably, that they feel's needed to process you case - give it to them

2. you should have copies of everything single thing you sent them - if you don't , shame, shame, shame. In addition, you should in my opinion, have BACK UP ORIGINALS, on hand. IE, when marrying it would be wise for everyone to get additional certificates of your marraige not just one. Example, for this USCIS process, and life's little unexpected surprises (illness, Katrina, fire) we have several cert copies of our birth certificates, marriage certificates, etc. At home and in a safety deposit box.

This isn't necessarily so. We were asked for additional evidence - the
blue form where they ask for everything that they've already asked for
on the I-751 form. And we were chosen for an interview.

Someone posted an excellent link regarding I-751's and how they are
processed that I found very helpful. It's from the adjudicator's
manual on the USCIS website.

Not just immigration-wise, but if you're going to have your name on the debt (mortgage), you should also have it on the asset (deed).

Send what you have. If it is still insufficient for them to make an affirmative judgment they will send you a notice that you will be required to attend an interview. It's not the end of the world. By the time you have the interview you will have more evidence, plus an in-person interview will add credibility to your ongoing marriage.

Didn't Mr.F already answer that question, and you quoted his answer?
Item #3, since you cannot give them what does not exist?

Alternatively, file the new mortgage with the county, if such a thing
is possible, so that you will have what they asked for?

We also sent in the Extension form that was filed with the IRS for
2005. I don't have any other joint returns. 2004, my husband arrived
in very late October and didn't work in November or December. 2005 is
the only year that we both worked and filed jointly. I suppose I
should have filed jointly since we were married in February 2004, but
we didn't. I fully expect to get an RFE. I barely sent in the volume
you did. I don't have much more to send in since we don't have joint
accounts, our cars (including his) are in my name with him on the
insurance since he couldn't get a loan/co-sign until after the first
year of his residency. I hope we get an interview since I think this
is the best way for us to show that we're a bonefide couple. I mean,
we are. How can you go wrong with an interview??

I dont think this is something you have to worry about... When we our about to do our AOS they also sent me an RFE saying my husband's salary didnt reach the Poverty Line and it did reach... so I sent again all the evidence and then in our interview I asked the Interviewer if thats normal and she said that expect that even you have all the documents you submitted you might be advised to send some more evidence or even to have an interview. She said its their computer...the computer is designed to have a random selection to send such letters.... even the interview letter so even if you got evrything you might even have an interview. Just the same send all the documents you send before.

I remember too our interviewer told us not to overdo the 751 documents, she said 2 bills evrymonth and a copy of check sometime issued by ur husband or the wife will do.

Dont worry evrything will be fine. Goodluck.
