RFE from TSC!
Hi,
Well despite our online status remaining unchanged, Kurt received an RFE in his mailbox today, dated 10th July. Our 1st NOA date was 30th January. Actually we are delighted, because since TSC are approving many February petitions recently, we felt ours had been passed over. The RFE says this: "Submit evidence that your prior marriages have ended." Of course, he did submit the divorce paper that his lawyer gave him after his divorce was finalized. However, the BCIS want a more official document, we believe with a stamp or seal or signature on it. Does anyone know exactly what? Debbie :) |

Debbie :) Without actually seeing the doucment you presented, no advice can be given. RFE's are often in "boilerplate" form and can be difficult even for experienced immigration lawyers to figure out. That said, I have often seen documents which clients bring in and they are not sufficient -- they can things like the "decree nisi", or here in California, there is a form "Notice of Entry of Judgement" which is NOT the same as the actual "judgement". [I've seen people get away with the Notice of Entry, but I've also seen it them bounced too]. |

Debbie :) After my divorce I recevied a copy from the county courthouse with a seal as well as a stamp with the initials of what I believe to be was the clerk that issued the copy to me. I gave that to my Immigration Attorney and he said it would be sufficient. If Kurt does not have this, I would expect he could get a copy. Copies from my local courthouse are $10. I hope that helps? Sad to hear about the RFE, at least you know your papers are now in the adjucator's tables. My TJ submitted with the original petition his divorce papers with the official seal and the signatures on it. I read from one posting that this is what INS wants to see. Debbie You leave out a lot of detail -- without seeing the documentation -- there is no way to figure it out. |
Thanks for your replies guys. Kurt has been down to the county courthouse and got a document which he says looks a lot like the other one, but has a much clearer stamp on it -- he believes what he sent in with the I-129f was a photocopy of a photocopy, which made the stamp look too unclear, so this time he is sending in a certified copy. He cannot obtain the actual "sealed" copy, which they hold on record, so he is hoping that this document he has obtained today is good enough. I will keep you posted!

Yes that's the right one!!!! :):) He needed the signed and sealed copy from the court. It should have a blue or red seal on the bottom of the page saying which court it was. Sal |
Sure is the right one:) I sent in a Certified Copy of my divorce decree and it worked! Good to see your file is being looked at. Sad when we welcome RFE's :D

i'm sorry about your rfe...
i would think a certified copy is way better than a photocopy of a photocopy... our rfe had to do with the divorce certificate too, so i guess it's common. hope it all gets sorted out soon! |
Hey Deb you're almost there now!!! :) I have a feeling i'm going to get the same RFE because my divorce decree is a copy of the true copy also.....at this point i wouldn't mind getting an RFE just knowing that they actually touched my petition at this point would make me happy!!

Carey Yes, that is how we felt -- at least they noticed our petition at last!! And from what I have read, if you give them what they want in the RFE, it doesn't seem to take many weeks until approval, so fingers crossed.... and here's hoping NSC pick up your petition soon too! just make sure its the final divorce decree... there is the agreement and then i think its something like six months after it is approved by the judge they send you the final decree.

the divorce paper will say decree absolut on it Debbie,Get him to check what it says!!!! :):)
