Hello all,
I just got an RFE for my I-130 (they need a copy of the RECORDED marriage
certificate!). I've also filed an I-129F for a K-3 visa. Anyone know if a delay in
the I-130 causes a delay for the issuance of the K3 visa? I would think not, however,
I don't know if the two offices cross check with each other.
Thanks! Phil

It's two separate processes so you have nothing to worry about.
What service center did you send your I-130 into?

Yes I'm afraid it will...stateside it will cost you a couple of weeks or so...RFE's
at the foreign US consulate can cost you 6-8-10 weeks+...as it has my wife and
I...we've had 2 RFE's and it is gut wrenching...best of luck...you'll need every
bit of it...

Phil,
I think the K3 visa center will ask for the same document. Did you send something
different for K3 application? I am afraid I may recieve REF later since I have NOT
sent out the copy of original Marriage certificate(issued by Chinese government). I
only sent out the copy of Notarized Marriage Certificate. I was told by other poster
that is enough. However, other said it was not enough.
Can you let me know if you submit any copy of document showing marriage???
Thanks,
Amelia

Had to hire an attorney in Manila...that ought to spell it out...submitted final K-3
packet to St Lukes Medical (they act as a conduit for the US Embassy in Manila) on
Jan 30th...RFE letter received by my wife first week in March...had to hire an
attorney to make changes to birth records...Embassy also asked for additional
documents not on THEIR checklist...RFE's submitted to US Embassy on May 6th...its now
June 15th...called the Embassy last week and asked how long do they think it will be
before a decision is made...they said maybe 6 to10 weeks after the RFE was
received....How am I/we doing?...AHHHHHHHHHHHHHHHHHHHHHHHHHHHHHHHHHHHHHHHH HHHH! And
that's with 2 letters to the Embassy Immigrant Bureau Chief in Manila from my
Congresswoman...

We only sent a copy of the Notarial English Translation of the Marriage Certificate
and the exact same thing for my wife's Birth Certificate and they accepted it with
no problems.
I've heard of others getting a RFE to send in the original document and the only
thing I can think of is that their Notarial English Translation is slightly different
then ours. Since my wife's Hukou is Shanghai, we got ours done in Shanghai and
apparently the INS likes the format the Shanghai Public Notary Offfice does it in.
People have described their documents as having some sort of metal binding to it,
while my wife's only uses regular glue and add a picture of us (for the marriage
certificate) inside it.

I don't see how getting an RFE for the I-130 effects the K-3 visa process, all you
need from the I-130 process is NOA #1 for the I-129F, I know several people that
have gotten a RFE for their I-130's (of course slowing down their whole I-130
process), but their wifes are happily in the US with them since the K-3 process
finished for them.
Now of course if you got an RFE for the I-129F, then the whole K-3 visa process would
be slowed down.
