Request for evidence
 

We just received a request for evidence today. Now the problem is that they
want proof of us meeting within the last two years...prior to filing the
petition. We live on the Cda/USA border and we don't have any travel
itineraries or airline tickets...nothing. We commute back and forth. I
never though to keep any kind of receipts. We do have some receipts showing
that we bought my engagement ring in Canada, my fiance (I'm the Canadian)
buys coal from Canada, as well as parts for equipment. We have receipts from
those, but that is it. Does anyone have any kind of advice??? Will these
few items work??? When we submitted the I129F, we included many photos of us
together, as we were told that would be sufficient. I'm just tired of the
delays and want to get this moving along.

I would say that 2 credit card receipts showing that you each bought
something in the same store 1 minute appart could be good enought.
You may include a copy of your respective credit cards to show that teh
two receipts are indeed yours.

When you crossed the border together, have you by chance once both had
your passport stamped ... that could could also be something to show
that you travelled together ...

Do you have any photo of the two of you that can reasonably appear to
be taken in the past two years ...

The more evidence, the better.

With an RFE, you can do 3 things:

1. Send more evidence of the type they are requesting, if you have it.

2. Re-send the evidence you previously sent, with a note saying this is all you have, and to please approve based on this.

3. Send only a note asking that they approve the petition based on the evidence you have previously sent.

The one thing you can't do is ignore the RFE.

I suppose including any receipts you can find that shows expenses paid in Canada by the USC, or paid by the Canadian in the USA would be helpful. At least it shows you both traveled back and forth. USCIS can assume you saw each other during those times.

I'm just curious who told you that photos only would be sufficient, and what other delays you've been experiencing this early in the process?

One would think that sworn statements, notarized, from friends and family verifying your time together..might be sufficient. American friends and family might be preferrable from a "sworn statement" point of view, given that the U.S. would have jurisdiction over them. Just a thought. Someone else here might know better on that idea.

They are usually a last ditch effort, if all else fails.

As Rene has mentioned, you can go with what you have and include a letter stating the obvious. You are both border residents and as such can easily drive across the border to visit one another without having to get an I-94 and that you stay in each other's homes when together so there is no need for a hotel bill, etc.

If any of the photos are from family gatherings, include them and indicate who is who in the photograph and their relationship to one or the other of you.

Look through your purse for any receipts for: gas, clothing, restaurants, etc. from his area and he can look through his collection of receipts for anything from your town. Receipts usually have the name, address and date on them.

Good luck and it is not the end of the world, really. The next thing you see one another start collecting new evidence. Save receipts, take photos with a newspaper in from of you. Take pictures in front of well known landmarks.

Thanks...but the problem is we live in a very small community....no passports
were ever used. We actually don't even have passports right now, I'm in the
process of getting mine and I've been bugging him to get his. When we
submitted our I129F, we gave them numerous photographs of the two of us
together as well as family members (my kids and his)..... When we shopped I
bought in Canada and in the USA he paid. Does anyone know if they will
accept affidavits from people that know that we have been together for 1 1/2
years???

It's worth a try. All you can do is submit more evidence (including affidavits) and see if they accept it. Include a statement describing your situation, detailing the fact that you are traveling by car across the Canadian border and living in small towns, therefore are lacking proof of travel.

Why is this an issue? A single photo of the two of you holding a recent copy of "USA Today" will solve the "problem". I can't believe you didn't think of something like this yourself.


Why is everything a problem for you? If you think this is all just a burden, you're doomed before you start. I'm sorry, but it seems as though everything for you is just a lame excuse!

Hi Rene,
When we first starting filing out all the ppwk in August we phone the 800# to
find out exactly what we needed to prove we had met in person prior to that
time. The person (agent) told us that we could send in photos of the 2 of us
together...so I sent in about 10 in different situations. Oh well....I won't
ignore the RFE. Our other delay has been that the website had told us that
the letter was sent Oct 11..we called 5 times on this and we still never
received anything. Finally yesterday when we called we were helped by the
most wonderful and helpful person...she found out our case numbers had been
mixed up...and then she got that mess fixed up and now we are working on what
we need.
It is truly hard when we live on the border to get the requested info...but
we will go with what we have. About 1/2 my relatives (aunts/uncles/cousins)
are USC, so I would not have a problem getting help from them.

OK, STOP telling us our waivers will be approved. Do you work for USCIS? Do you know our full names and our case numbers????

STOP telling us it's in g.o.d.'s hands. That's bollox, it's in the hands of the officers dealing with our cases.

STOP telling us what we want to hear. It gets our hopes up.......just because "you" were approved, DOES NOT MEAN WE WILL BE, DARNIT!

Funny, I don't recall posting that on here. Nobody on this site gives a toss about waivers anyway. Second of all, that was me asking people to stop telling me that bullshit (which I have had in so many pm's it's not even funny). That post wasn't intended to be bitchy and was not directed at anyone in particluar because we're all going through our stuff.

We got an RFE for our K-1 application, and didn't have much more info to
send (I think I found one more plane ticket, maybe a hotel receipt), so we
included sworn affadavits from both our parents that we had stayed in our
parent's homes when visiting each other and they had seen us together.

We were approved.

Mind you, they also stipulated they needed evidence of us meeting 2 years in
the future (i.e. we submitted Oct/03, they wanted evidence of meeting
between Oct/03 and Oct/05), so not sure what was the mitigating factor
there.
