Default Removal of Conditions

Hello,

Two questions regarding removal of conditions:

1st: What is the current filing fee?
2nd: Do the affidavits have to be notarized?

Peter,

1: It's on the USCIS web site.
2: Not only do affidavits not need to be notarized, they don't need to be provided.

Hi Jeff,

In the instructions for the removal of conditions it says to provide
affidavits sworn to or affirmed by at least two people who have known both
of you since conditional residence was granted.
Are these affidavits no longer required?

"Evidence of the Relationship. Submit copies of documents indicating that the
marriage upon which you were granted conditional status was entered in ''good
faith'' and was not the purpose of circumventing immigration laws. Submit
copies of as many documents as you wish to establish this fact and to
demonstrate the circumstances of the relationship from the date of the marriage
to the present date, and to demonstrate any circumstances surrounding the end
of the relationship, if it has ended. The documents should cover the period
from the date of your marriage to the filing of this petition. Examples of
such documents are:

Affidavits sworn to or affirmed by at least two people who have known both of
you since your conditional residence was granted and have personal knowledge of
your marriage and relationship. (Such persons may be required to testify
before an immigration officer as to the information contained in the
affidavit.) The original affidavit must be submitted and also contain the
following information regarding the person making the affidavit: his or her
full name and address; date and place of birth; relationship to you or your
spouse, if any; and full information and complete details explaining how the
person acquired his or her knowledge. Affidavits must be supported by other
types of evidence listed above."

Nowhere does it say you must send them, just says they are one type of proof
you can send.

Peter,

No, it doesn't. Read carefully - the instructions say that affidavits are one type of evidence that may be provided.

It also says that afficavits must be supported by other types of listed evidence, i.e. other evidence that needs to be provided anyway, which may be why affidavits are weak evidence according to one attorney who posts here frequently.

Just a thought........... if USC had to prove their relationships before they got married like how US/Expats had to keep proving our relationship there would be less divorces.
