There is a fair chance that may happen. That DNA taken from the son will be challenged. The girlfriend did not have guardianship rights and as such the father should have been advised before any evidence was taken. Even though they now have his DNA, it was obtained from evidence produced by DNA swab taken from the son.

As to the death penalty, and retribution, well, Bapu famously said, "and eye for eye and the world shall go blind". But technically, that's not true.
Let's say person A stabs person B in the eye.
Person B then stabs A in the eye.
Now person A stabs B again, blinding him.
A still has one eye left and can dodge any attacks.
In the world of the blind, the one-eyed man is king.
Let's say person A stabs person B in the eye.
