Default Questions: I-864 and few others

Hello,
While filing for I-864, the instruction says that tax returns and w-2s of
the last three years are required, skimming through this NG reveals that tax
transcripts from the IRS may be used. So is it ok to send tax transcripts
instead of returns and w-2s since my wife disposed or lost them?

Another thing, we got married in San Francisco and we're moving to Utah,
which USCIS center should we file the papers? The one that governs
California or Utah?

When in doubt, I always go by the instructions on the form. I've also heard
that tax transcripts were acceptable, but the instructions say complete tax
return. So that's what I sent in. The W-2's are only required if you filed
a joint return and are only using your own income to qualify.

From the I-485 instructions:

... evidence of income:

A copy of your complete Federal income tax return, as
filed with the Internal Revenue Service, for each of the
most recent 3 tax years. .... If you filed a joint income tax
return and are using only your own income to qualify,
you must also submit copies of your W-2s for each of
the most recent 3 tax years,

Yes you can use transcripts. I don't believe there is a requirement for
W-2's unless you filed a joint return and need to prove which part of
the income is your's.

The location that serves where you live when you file.
Where you got married is never relevant to where you file.

Tax transcripts are much easier to use in my opinion, the only hard part is waiting to get from the IRS - especially if your wife has lost her w-2s and original forms.

How quickly do you need to file the paperwork? If you need it filed asap, and, I assume, you live in San Fran, you may want to file there. However, if you're moving soon (like in a few weeks), and you're moving to a long term residence, you could always wait to file until you're in Utah. But there is always a chance that paperwork could be lost, and change of address forms never updated in the system, and goverment documents are not forwarded to new addresses. We're facing the same situation - not different states, but a change of address nonetheless. It's a tough situation - I worry that we'll miss/not receive notices once we move, but I absolutely cannot stand to stay in my apt for the next year or so (it just ain't gonna happen).

Can't one still walk into their friendly neighborhood IRS office and get them over the counter?

Eric,

That instruction you quoted does not say "W-2's are ONLY required if you filed a joint return and are only using your own income to qualify." (The emphasis on the word 'only' is mine.) The instruction says that W-2s are required in that circumstance. It does not address whether or not they might be required in other circumstances.

W-2s can be required in other circumstances if the person who is reviewing the information wants to see them. The anecdotal evidence is that this happens quite often.

This is why we are going to include the W-2's too even though my fiancé never filed a joint return.
If I weren't reading this NG, I don't think we would include them because the information on the forms clearly gives the impression that the W-2's are ONLY needed when there was a joint return filed...

So anyway, it's going to be "tax returns" and "W-2's" for us. No tax transcripts. Those are obviously not needed if you have the returns.

Regarding the W-2's - I lost one of mine and my employer was able to get me a photocopy for that particular year.

W-2 information can also be obtained with a tax transcript by checking the appropriate box on IRS Form 4506-T.

If one wants complete W-2 information (state and local as well as federal) use Form 4506 and request a copy of the tax return rather than a transcript.

Hi, I'm from France. I'll be marrying an American woman soon. We're both
young under 30s, she doesn't have tax returns papers and neither do I. I've
been on the working market for less than a year and in France. What kind of
evidence are they going to ask for. I've tax returns from my parents saying
that I was not to pay taxes. Thank you and good luck.
