Default Questions on I-765

I am an F1 visa holder with a work permit (OPT) which is effective from Jan
2004 to Jan 2005.



My wife is a US citizen, and she is going to file I-130 and related forms
(I-485) for me in March 2004. My question is that given I have my OPT which
is only valid for 12 months, do I need to file I-765. If my OPT is expired
by Jan 2005 and my permanent residency is still under process, Can I still
work..

The simple answer is that you cannot work without a valid work permit even
with a pending I-130 and I-485.

You need to get work authorization, like an EAD, to be able to continue to
work.
