Default A question of time

Hi again, I again have a few more questions and would appreciate any help I can get.
Keeping in mind that I did not come to the USA on a K1 visa, only a visitor visa, and
I am Canadian.

1) Once my fiancé and I marry, is there a timeline we have to get to the INS office
to file the required documents? Just asking this question as he will have to
arrange time off from work and wondering if there is a time frame we need to
keep in mind.
2) I read in one of the documents that I need to have a evidence of status, I came
here to the US on a visitor visa from Canada, there is no document issued for
this, I flew here and entered via the Philly International Airport. Any idea what
evidence I will need?
3) On the form I-765 it says I need a copy of form I-94 (departure record), any idea
what this is and if I need it what is it and where do I get it?

Jewel what did you come in on?? a K3 or are you just planning to get married first.

Hi,

I entered just as a visitor, with no specific visa, yes we are planning to marry
within the next few weeks, and will be filing with the INS using the I-485 AOS/I-130

Before the time limits of your tourist visa, waiver, or whatever they call it for
Canadians, would expire.

Why does he need time off work? Does your office accept filing by mail or have a drop
box? The interview itself can take months to years to be scheduled.

Did you fill out a I-94 or I-94W on the plane or at the airport?

I know you don't get one for a land crossing, but I thought you got one when flying.
It is the form you fill out and give to the INS people when arriving in the US (or
leaving Canada, I think)

you might have to leave the US after 6 months, better find out about that

no she won't have to leave, providing she entered legally and files for AOS before
the 6 month visitor time limit is up...and even if she overstays, she can still
become a legal resident based on marriage to a US citizen, as long as she doesn't
leave during the process and before she gets her green card.
