Default question regarding 864 (Rete & others pls advise)

As I had mentioned earleir, I have my AOS interview in ATLANTA on AUGUST 17th. I had a question on I-864. When I had filed my AOS in 2002, my wife was no working and we had a joint sponsor.

Now, me and my wife both have decent jobs. We are well above the poverty line, have filed 3 joint tax returns so far.

For my interview, my questions are:

1). I will be using the new 864 along with my wife showing her as my sponsor, since now she is earning. Is this correct?

I will also club my income as we have been living with each other since 2001?

She will have only 2 W2's as she is working from 2 years, any issues with that?

2). I will also fill out I864A to be on the safe side, will it be ok?

3). Do we still need to get W2's from our co-sponsor whose W2's we had sent when we filed in 2002?

Rete or anyone, plse help. Thanks.

Does your 2003 tax return show above the poverty level for your household size? If it does then you shouldnt be concerned even if 2001,2002 doesnt show above the poverty guidelines. They dont say it, but usually the last filed tax return along with proof of emplyoment right now will be enough to satisfy them as long as your current income looks good enough. Good Luck

Do up a new I-864 and include your wife's income with it. Ask to have it substitute for the co-sponsor's original I-864. They should accept it even if all three years are not over the guidelines. The most important one is the last year and the current year.

Good Luck

Here's another question regarding the I-864.
Well.. a few questions...

Since we just did our I-864 like two months ago, do we need to supply a new one at the interview?

If we do, my husband makes enough NOW to be aboved the required income limits, but its not reflected on his last 3 tax returns, as he's only received a promotion in the past six months or so. Will this be good enough, or do we still need a co-sponser? (We had his parents do an I-864 for us as well as a co-sponser on the original application. If need be, we could do this again if we need to re-do it...) I'm thinking of just getting his parents to do one just in case?
