Question on DS-260

Default Question on DS-260

I’m USC husband UKC... he is filling out the DS-260 and there is a question that asked has he ever been issued a Visa.... he was. Permanent Resident from 1999 to 2012 as a US spousal Visa...so he was issued a Visa.
However the choices of what Visa he was issued does not show just a regular spousal visa. They all have “spouse of a ## visa”... but no regular spousal visa....
what should he answer??
prior to that question he was ask if he had an Alien number.. which he did until we asked to cancel it... do we say no to that as currently he doesn’t have one...
This is quite confusing... HELP !!!

Just answer to the best of his ability, and then any discrepancies can be cleared up at the visa interview.

You cannot cannot cancel an Alien #. You cancelled his green card. The number is still viable and should be placed in the appropriate section on the form(s).

There have certainly been other cases discussed here on BE where a spouse visa is being applied for, and the advice under these circumstances, and many others, was condensed to three rules by a very well respected former member of the BE forum who has disengaged from the board and sadly no longer posts.

The "three rules" which will stand you in good stead for completing the forms are as follows:

1) Take each question at face value;
2) Do not ascribe any meaning to the question beyond that which is plainly written; and
3) Do not try to alter the question to fit your circumstances.

In other words, if the form asks for information about "any previous visas", then answer to the best of your ability, using the closest of the alternatives.

And as per Rete above, an A# is for life, like an SSN. If someone has an A# and llives in the US for a period, then leaves the US (without becoming a US citizen) for a period many years, and later returns to the US again to live as a resident alien, they will still have the same A#.
