Elaine,

There are not 3 alternative visa scenarios for a spouse (and child), there are only 2 - CR immigrant visa and K non-immgrant visa.

In either scenario, the first step is an I-130 petition. If that 1st step can be taken at a consulate (DCF) rather than at a CIS service center, great. DCF provides a short-cut to an application for CR visa, not an alternative to it.

Regards, JEff

I am really kind of confused by the original poster's questions I think. I know the I-130 can be used with a K3, AND for consular filing AND without a K3 if you want to wait it out (all simply put).

I will send it Monday.
Any other options.?
Thanks everyone for all the info.

Yup just file the I-130 for a CR visa. That will be his own visa by the way, and has nothing to do with his mother's visa (that includes the processing time). I don't know what the current timeline is for an I-130 filed stateside, but that would be what you're looking at.
I don't think there are other options, assuming you've looked into the possibility for him qualifying as a US citizen. If he is your son he may be able to claim citizenship.

Hi Elaine,
I just got off the phone with CIS. They dont know anything about CR-2.
They said to just file the I-130 and go through the same process as I
did with my wife. (but no 325a)
Well, now I know. I just hope that other people dont totally believe
information they hear from friends. I am sure that they ment well.
They probably got confused with K1/K2.

Oh Well, everything will work out ok,I hope.
I hope that other people dont make that same mistake.
Thanks Again,
Larry

Hey, thanks for filling me in on that, I was wondering about it. I used to think in terms of CR1/2 as well, but then found out it isn't derivative so I figured there isn't such a thing as a CR2. Thanks to you I know for sure now.

I hope things will go smoothly for you all from now on. Good luck!

But an I-130 would be needed for the kid for AOS.

Hi:

True -- but filing of the I-130 for the kid was NOT required for issuance of the K-4 visa.
