My fiancee entered the US on a visa 14 years ago, but didn't return when it expired. He has lived there since.

I live in the UK and we plan to return to his country to apply for a visa for him to settle here with me in the uk.

1. What can we expect to happen when we leave the US with him having overstayed? Will he be allowed to just leave? ( I know he will have a 10 year ban )

2. How will this affect him obtaining a visa to the UK? Is it likely to be denied because of this?

There is nothing stopping him leaving the US ...
what is his citizenship???

Nothing.

No idea. If they discover he doesn't believe in abiding by immigration
laws, I can't imagine they'd be too happy.

Just out of curiousity, what visa did he enter on?

When you say "his country" do you mean the USA, or his native country, other than USA?

Shouldn't be a problem for him just leaving. Problems will arise if he tries to return to the USA.

2. How will this affect him obtaining a visa to the UK? Is it likely to be denied because of this?
Probably not. Where are you going to apply for his visa to the UK?

Thanks for all your advice.

We plan on returning to his own country ( Domnican republic) to apply for the visa. We've been told this is the only way to do it?

My only concern is he'll be denied the visa because of his overstay in the US. But until we try, I guess we'll never know

You've been told... by whom?

Have you seen if it is possible for him to apply for the visa thru the UK Embassy in the US?

But surely because he's overstaying his visa he won't be allowed to apply in the US, because he's not even supposed to be there??

At what point will the UK immigration officials ask him about his status in the US?

I don't know the answers to these questions, but I encourage you to ask them. You may be surprised by the answers.

The forms themselves don't ask about his US status as such.

It does state however that non US residents should apply in their own country. Applying in the US would have made things a zillion times easier.

thanks Ray, It's something to think about. I wouldn't want it to jepordise anything though, given his current situation ( I'm not even sure that it would?)
