Default Q re. 10-year ban

A relative of mine recently applied for a student visa and was denied it on grounds
of having previously overstayed his visitor visa by 8 months (he'd been issued a
year-long visa, but the passport was stamped for 6 months, and then he failed to
extend that while in the US).

How definite are these bans, is it worth hiring a lawyer in this case to try to
reverse it?

I'm no lawyer, but, if he has docments to prove that he had a valid visa at the time, I would have thought that he has grounds for getting the decision reversed.
