Problem with kids' visit to AOSing mum?
 

Hi all,

My wife and I married while she was in the US on a visitor's visa, and
we have just recently filed for AOS.

Her daughters (15 and 17) are planning a visit in two weeks. One
daughter has a B-2, because she was originally slated to come with her
mother for the lengthy visit that happened to turn into marriage (we'd
originally thought we'd go back to Aussie and DCF if things worked
out).

The other daughter will come on visa waiver.

When asked reason for visit at the POE, they will probably say "We're
visiting our mother who married an American".

Questions:

Is either daughter liable to run into trouble at POE because their
mother is awaiting AOS? I.e., will they be suspected of surreptious
intent to immigrate?

Is there any documentation that they can carry to show that they are
planning to return to their lives in Aussie (as is in fact the case)
after the 3 week visit?

Any other advice for us in this situation? I just don't want the
heartbreak of them coming to visit and running into snags just as they
are about to be with their mother after a long separation. And after
reading immigration forums for many months I take nothing for granted.

Yes

Court custodial order showing the other parent has custody.
I doubt there is much else they can do to show they have a bigger reason
to remain in Canada than to be with their mother in the US who just
married on while a visitor. It really is going to depend on the
individual inspector.

Prepare them for NOT being able to enter. Then if they do get in, all
the better. If they do get in, I would NOT trying to AOS them on that entry.

You've quite a good memory.

No, *definitely* not on this visit, at the very least, and maybe never.
She's *absolutely* going back to Australia after this visit, and
furthermore she hasn't even been convinced to immigrate at all in
future. That's her mother's desire, but so far not hers.

And even if she all fell over herself while here gushing with her
vervent new desire to move to the US with her mum, she'd be going back
to Aussie from this visit exactly as scheduled. After she was back in
Aussie, then we'd find out how to do it right.

Speaking of which, to revisit the aforementioned prior question, after
she's back in Aussie again how would we do it right should she change
her mind?

If you want the real truth -- II's hate "bouncing" teens and kids after a 14 hour flight. So they rarely do. But don't take advantage of it, or 100% assume it all the time.

Most likely i've heard they ask for the phone number of the parent or where they are in the airport -- and call them and give them a good yelling on the phone or in person. Then admit them in. They don't grill kids or minors. They have no idea what's going on.
