Default Possible company buyout, how will this affect my greencard application?

My current employer may soon be bought by a much larger company and I
was wondering how this might affect my green card application.

I have the receipt notice from my EB3 green card application, and we've
just filed for my H1-B 7th year extension. LC was approved several
months ago.

Will the buyout mean I have to refile stuff or restart the process for
the much larger company, or will everything remain unchanged?

Cheers!
Bob.

Hi:

It depends. It might, it might not. You ask some excellent questions.

The new employer will certainly have to file a new I-140 upon your
behalf (unless this was simply a sale of stock in your current employer
and your actual employer doesn't change). If the new employer assumed
substantially all of the assets and all of the immigration related
liabilities of your current employer then, per a recent letter from a
high ranking CIS official, it should not be necessary for a new labor
certification to be filed upon your behalf.

This is not legal advice. I am not your attorney. Send follow up
messages to [email protected]. I do not check the newsgroup for
updates.
