Please! Really Need HELP on I-864

Default Please! Really Need HELP on I-864

My wife is a US Citizen, and i came here in the US as K3 visa, and
working already, we decided to adjust my status in my home country so i
will do the IR1 route, we are preparing for Affidavid of support now,
this is our questions hope someone would help us.
1. Can i include my income on the affidavid of support? if no one will
be migrating with me? coz it said there i need to file I-864A, but some
instruction i read i dont need to file and i can just include my
earnings for the year, if so will i have to include a letter of my
employer?

2. My wife is having problem with the bank coz in the pass she always
have negative on her account, so she cant open account coz she has bad
records on the bank, can she use my savings account instead to show
proof of saving since my account is her account also physically but not
documented since the account is on my name.

3. My wife is a student for the others years so she has only last year
for IRS to show the income tax since we joint file for the tax, but she
work also during the time when she is in school but its just a part
time job, and she didnt file tax with that years. will she be in touble
if we will just put as explanation that she is student with in the last
2 years thats why she didnt file TAX? since she earn a little bit and
her mom say dont file a tax. is that right..

If you been in the US for 6 months you should be able to use yourself as
support

Why marry a irrsponsible woman who abuses credit and banks?

Yes im here for morethan a year that means i can use my income to
support? will i have to file separate I864A?

I guest thats because i love her, so i dont care if she has problem
with banks or anything, now i have to support and help her. as well.

Yes I think you will have to file it youself.

The instructions of who can file are on the form.

Wel eventaully your credit score will be bound together when you start
buying thing on credit and soon enough you will have bad credit also
becauseof her and you will have problem buying things on credit

Yes, you can include your income on the I-864 your wife fills in, but the instructions are a bit difficult to interpret when an I-864A is required. Best option is to have one ready,should it be required. As to the tax issue, your wife should check the IRS taxable income minimums for the years she did not file returns. In the event that she did not exceed the income which requires a tax return, then all she needs to do is explain that her income was insufficient to require a tax return, (for the Affidavit of Support). On the other hand, if she really should have filed, then it would be wise to do so. The sooner she does file, the better, if only for the peace of mind and to put a stop to any mounting interest.

Thanks for your help, good news we just pay all the balance that she
has in other banks and finally i include her in my bank account hehehe,
now i have to control her on financials. i have read the instruction on
IRS and this is what it said.

Topic 351 - Who Must File?

Whether you have to file a tax return for 2004, depends, in part, on
your filing status, age, and gross income. You will hear the filing
status, age, and amount of gross income that would require you to file.


Single, under 65, and your gross income was at least $7,950.
Single, 65 or older, and your gross income was at least $9,150.
Married, filing a joint return, you and your spouse were both under 65,
and your gross income was at least $15,900.
Married, filing a joint return, one spouse is 65 or older, and your
gross income was at least $16,850.
Married, filing a joint return, both you and your spouse were 65 or
older, and your gross income was at least $17,800.
Married, filing a separate return, and your gross income was at least
$3,100, regardless of your age.
Head of household, under 65, and your gross income was at least
$10,250.
Head of household, 65 or older, and your gross income was at least
$11,450.
Qualifying widow or widower with a dependent child, you were under 65,
and your gross income was at least $12,800.
Qualifying widow or widower with a dependent child, you were 65 or
older, and your gross income was at least $13,750.

Gross income includes all income you receive in the form of money,
goods, property, and services that is not exempt from tax. Even though
your gross income was less than the amount stated for your age and
filing status, you may have to file a tax return.

You must file a tax return if you had net earnings from
self-employment of $400 or more. Net earnings from self-employment
is your total self-employment income less the expenses paid in
operating your trade or business, multiplied by 92.35%. For more
details, refer to Publication 533, Self-Employment Tax.
