here`s my little story......I met this lady from canada and she is a
canadian citizen so she can visit the U.S without a visa.......I was
wanting to know this.....We would like to marry but dont know if she
needs a fiance visa or not im thinking she dont need.We will marry and
she will return to canada until she gets all her stuff done first can we
marry and she return to canada for a few months then return? I called my
local marriage license place at the court house and was told to talk to
the county atourney office and they called me back and said i could
marry he as long as she is 18 years of age.......Do i have to file a
fiance visa? she dont need nothing to enter the U.S to visit why cant we
just marry then file for s.s number and workers permit later? Please
tell me what must i do. Thanks

If you marry her and she leaves and subsequently you file for her GC, she
will have to wait in Canada for her visa. If she does not leave, she can stay
with you and adjust status while in the states...

Technically, she must have a fiancee visa (K-1) if she is entering for
the purpose of marrying a USA citizen and staying in the USA.
Therefore, she must not form the intention to marry you until after
she enters the USA. She can enter the USA for the purpose of attending
a Buffalo Sabres hockey game with you, and then decide to get married,
but filing for a green card and then leaving the USA constitutes
abandoning the green card application.

At some point in the green card application, you can go to INS and get
a stamp in her passport that says she can leave the USA without losing
her application.

What if we marry and she returns back to canada for a few months and
then i file for a fiance visa when she returns in a few months?

How can you file for a "fiancee" visa if you are already married?? That is
visa fraud. You will have to file for a spouse visa if she leaves right after
you marry.
