Default Petitioner Name change and K3 Visa

Here is the scenario: My wife had her passport before I became US
citizen. As it is the case in Bangladesh passport, she has a field in
her passport that says Father's/Husband's name (for married girl its
husband and for everyone else its father). So, she has my name there.

Then, when becoming US citizen, I took the option of name change
through a court order. But her passport is having my old name as it is
a BIG pain to change it there. The reason it is really hard to change
it: my name has changed in USA but not in Bangladesh. So, I have to go
to Bangladesh to do the same, and then change my marridge document and
then after seeing the marridge document, they will change the passport.
So, I just asked her to face the interview with the old name and see
what happens. But I'm worried about it. Do you guys think (know) it
could be a problem and they would ask her to go change the passport?

The only reason I could think of that would make them to ask for
passport to change is that if K3 visa would have my name on it, and
they would not want to show my old name there (if not it whould show
the same passport with 2 different husband name). So, does K3 visa
contains husband's name? and what are the chances she would be asked to
change the passport?

I don't know how it would be specifically in Bangladesh, but in general, it is not required that a wife take her husband's name. There are many couples who are married, and have different family names. As long as she can prove your marriage is legitimate (marriage certificate), I don't think it should be a problem to keep her own name as is. Her visa will be issued in whatever name she used to apply for the K-3 visa.

Best Wishes,
Rene

In the US, a woman doesn't have to take her husband's last name if she doesn't want to. Some men actually take their wife's last name. My wife didn't take my last name... in fact, she kept the last name of her former husband... and I really don't care one way or the other. The US has no interest in how Bangladesh handles such things. Someone looking at her passport would probably assume, since your name is now different, that this is her father's name.

I guess I did not make my question clear. Does "My" old name being in
her passport is a issue while issuing the visa. would they want her to
change my name to the current one? she has only one name all over, and
I know that is not a problem. my only concern is, since her passport
has a field for father's/husband's name (with father's name crossed
off, so there is not confusion who's name it is), would the US embassy
ask her to get her passport updated?

Her passport is the property of the Bangladesh government. The US has no authority to request that someone make a change in a foreign passport.

Understood you the first time. I'm not familiar with name changes with naturalization as therefore do not know if they give you paperwork showing what your former name was and showing your new name. If so that is all that is needed. She has her K-3 in your former name and you need to show what your former name was before the change.

Also note that the USCIS will be able to access your data on the computer system to affirm what you have told us.

yes, they gave me a paper work showing my former and current name. i
applied after naturalization, so applied with new name. her passport
was done before my naturalization, so it has my old name.

thanks for all the replies, and please let me know if anyone need more
clarification.

once again, thanks.
