Petition filed, can sponsor move? See details...
hey guys!
so I have filed the I-130 for my spouse and we are waiting it to be processed. My job situation is in turmoil and I need to go back to the states sooner than my spouse’s visa will be ready (we’re talking in three months time as compared to the 7-10 months it will take for his visa). We have filed in the UK as residents as we live here (I’m currently on a tier 2 general visa). Does this affect our current application? Will we have to re-file/apply under a different form or will I just have to fly back when it is time for our interview? Any thoughts?

Once you have filed the application sponsoring your spouse, you can do whatever you like - stay, move back to the US, spend the next six months in Cambodia if you like. It is pretty irrelevant what you do, so long as you meet the criteria for sponsoring your spouse, which primarily means either accompanying him/her to the US, or already being (living) there when they arrive.

Also, you don't have to fly back for the interview. Your presence is not required.
