Is anyone waiting a long as us?
We married in February, 2002 (I am a US citizen, my wife is a foreign
national). We filed our I-485, I-130, etc. in April, 2002 which our lawyer
filed with the NYC office. She was able to get an EAD and SSN quickly,
however it wasn't until FEB, 2004 did we received an official Notice
indicating that out I485 & I130 was filed (in Lee Summit, MO!!) with a
priority date of APRIL, 2002. She completed the fingerprinting & biometric
in May, 2004. Recently we renewed her EAD for the 3rd time!! Not an
inexepensive process.
After 120 days since receiving our Notice, I contact NCS, which is what the
Notice said to do in case we have not heard from them. I have made FOUR(4)
referrals (status check) at 30 days intervals. The first of these referrals
were with the National Service Center (toll-free number) representative, but
upon the 4th attempt, they connected me to an Immigration Officer who pretty
much just did they same thing as the representatives, process another
referral request.
Is the next step waiting for a interview appointment? (I am approaching my
3rd anniversary, so I am well beyond the required 2 years.) Or will she
just receive a notice that her Permanent Residence is approved and she will
receive her GC within 90 days (a year in reality)?
We have two(2) friends who got married earlier THIS YEAR, filed for
permanent resident, & already completed their interviews recently complete
with temporary stamp in their passport. Same situation as us, foreign
nationals married to U.S. citizens. Are we just unlucky?
Thanks for any advice.

NYC is part of a new pilot program and anyone who filed during late 2003 and 2004 are adjusted within 4 to 6 months from filing. According to columnist Allen Wernick fo the New York Daily News, you have the option of refiling a new I-485 and I-130 now and speeding the process along. The only catch is that to adjust status the NYC office has to get your file first and that might take time. Curious as to why your NOA was from Lee Summit, MO. I know that is where the National Records Center is and NYC does send files there for storage before adjudication. This happened to us as well. Or this your NOA come from the MSC Missour Service Center? If yes, then that is the normal processing of all adjustment petitions. It is received by the DO and then sent to the MSC for initial processing. How long will it take them to get around to adjudicating you? No one knows for sure. If your attorney is not instrumental in getting action on your case after all this time, perhaps it is time to get your political representative involved.
