How does a person who is out of status file their taxes? If they have an SSN acquired
before going out of status do they use that or a TIN? What are the penalties/risks of
filing vs. not filing at all?
Thanks!

Yes, you still need to file your taxes. Your Social Security Number is yours for
life, whether you remain in the US or not, whether you are working or not. You
should always use that number on IRS forms and on any future INS paperwork that asks
for your SSN. As for penalties for not filing taxes - ask Al Capone. (He was a head
of large crime family who ended up in prison for failure to pay income tax) Take
Care. Shelley
