Which option is better to marry Fiance?

Default Which option is better to marry Fiance?

Hello,

I'm planning to marry my fiance next year, and I've been told that
there are two options I could follow. The first is through form
I-129F, and the other is marrying her while she is visiting me here
(she comes to see me many times a year). Most people have told me
that it's better to do it through the first option as there wouldn't
be too many problems. It seems that with the second option she
wouldn't be able to go back to her country until her papers come
through in two years or so, right? Are there any other issues that I
should know about if we decide for the second option? Would there be
any problems for her getting a permission to work? What do you guys
think I should do? Any help would be greatly appreciated.

I think the fiance visa (K1, I129F) is the better option but this is an
undeducated opinion. I am not sure of this but talking to others and also my
congressman, it seems that INS looks "better" on this situation when they
make decisions because it doesn't look like you "rushed" into a marriage. Of
course this depends upon the situation.. I did the fiance visa and although
it took some time (7 months from when I first sent the 129F in until she was
here with me), everything went smoothly, without any hiccups.
Just my opinion.

Yes they are the two options and the third is to marry and have her return to her country and apply for the I-130 for her while she is there and you here. And the fourth is to marry her in her country if the US Consulate in that country does direct consular filing with the USC not having legal residence there. That is the most expeitent method.

The K-1 is the safest way although it appears round about. There are issues with her marrying while visiting you here that Mr. Udall will be happy to explain in numerous paragraphs detailing the issue of lying at the POE when entering.

If you did it, she would have to file for advance parole via form I-131 which will allow her to re-enter the US after leaving it during the wait for her adjustmen of status interview. Also if she wants a social security card and the right to work she would need to apply for an Employment Authorization Document via form I-765.

Thank you for the information and good wishes Jeff. I'm more inclined
to the K1, 129F option now, as I don't want to have any problems with
such serious matter. If waiting so many months is the only issue,
then I guess having a little patience will have to do. Thanks again.

Thank you Rete. I didn't know about the issues with the second option
(and what we would have to do if we went with it), and now I think
that the first option is the safest bet. Thanks again for clearing
this up for me.
