Default OMG!! Major oversight!! Help..

I just realized that I don't meet the 125% poverty guideline if I don't use my child support. So.. How do I use my child support if it's not on my tax return? How do I prove it?
I don't see anything on the BCIS website for that...

where do you list it..??? there's no place for it..
a second job??? too late for that...
an amended return? you mean CLAIM my child support??? no way!!! I'm not required to do that...by law.. can you imagine the taxes I'd have to pay?

Really??? Where do you see that? I don't see ANYTHING about using child support as part of the requirement..

So what exactly do I attach??? Just a note or what?

Ruthann1212,

Here is the question on INS I-134 "I derive an annual income of $-----------"? You should add you current salary/wages and your child support income. For example, $14,000 (salary) + $6000 (child support) = $20000, then you should list $20000 as annual income.
Meanwhile, you will need to document it by providing, copies of child support checks and/or transcripts if applicable (be sure it is notarized or certified). Note: Remember, how your income is presented, matters!

Also, try to document consistency of child support income (it is important, if you will use it as part of household annual income.

How will they determine family size/income once my two sons, who live with
me, are no longer on subsidy but SSI? One is on SSI now and the other will be
in a few months? Since they still reside with me, I can claim them on my tax
returns. Will they expect me to have an income for a family of four (me,
husband, 2 boys) and will they count in the SSI payments toward the household
income?

Child support doesn't go on a tax return.

In theory, the court ordered it, so it should be guaranteed
But.. USCIS will count it.

It was GREAT!!! talking to you for what --- 3hours?? -- last nite. Our men hooked up today and J called while they were both in the cafe. I think they're gonna stick together while in Lagos and tha's just fantastic.
I really dont have any answer to your quandry but maybe getting a co-sponsor would help to boost the income requirement. WHile I also recieve CSP payments i did not need to use it as my income is sufficient. SO if i had to, i'd probably be asking just as you are.

It'll all work out in the end. Don't worry so dear, it'll be alright.
