Default No stamp after interview - one year later.

I am a British Citizen. Came here on a K-1 fiancee visa in Feb 2002.
(We thought we were doing things the 'right' way) Filed AOS March of
2002. Fingerprinted sometime in May, interviewed in November 2002.

We were told no stamp due to the officer wanting a couple more items
(they had lost my medical, even though it was in the brown envelope I
handed over when entering. Oh, they lost the brown envelope and told
me off for handing it in at POE). So, we did it all again, sent it in
and when I went down to our local INS, I was told we were approved
December 26th 2002. However, we were on these bloody holds for
security checks. But, we would hear something in about 3 weeks! One
year later, nothing. Contacted congressman, and I get another letter
about more fingerprints. Had those end of January and here we sit,
still waiting.

I do not want another interview. I do not want to wait any more. I
want to know that we can start planning our life properly, buying
property, a car, having a family.

Is anyone else going through this?

Yes. There's a poster here who filed in Miami (the same one as me, so I'm not hopeful about achieving the famed AOS stamp ). She called the FBI, who told her the results of her fingerprints had been completed and sent back to Miami, and a year later, she's still waiting too. I have also been told by the FBI that my fingerprint check has been completed and was sent back the same day. I just don't understand how USCIS can say that they're waiting on fp results/security checks/my colleague who went to get my bagel........etc etc when the FBI have confirmed completion of these checks.

Sorry for the vent, but I get soooo peed off when I see people still waiting months or even a year after their AOS interview, and if that "security check" scenario happens to us, I'll be contacting the Congress office to find out who's telling the truth about the fingerprint check. FBI or USCIS? (Unless I'm venting for no reason whatsoever and there are other "security checks" they do, but to me, who's checks are more important that the FBI's?)

Hi Kate...the CIA checks are the time consumers, they apparently are completely overloaded.

We are on the same boat Eli...It's gonna be a year in March since we had the AOS interview. Oh boy! I might be going for another fingerprinting since it's only valid for a year.

As much as we don't want to wait...what else can we do? We tried every possible ways but still nothing happened.

Can we start the protest now? *sigh* *sigh* *sigh*

And whether or not they were aware the fingerprint check only applied to
battlefield weapons? ;p

Well...this will teach me to speak too soon. I got home this evening
to a letter asking me to come down and get the stamp in my passport

Only thing is, our 2 year anniversary is one week from today! *kicks
INS* Why couldn't they have waited one more week since they waited a
year and two months? *grins*

When you go in to get it stamped it may be worth asking if they can postpone the approval for a week...THEY MIGHT...

It will be 14 months on the 23rd of this month and no stamp. I'm not
doing any inquiry now because my 2 year wedding anniversary will be at
the beginning of July. If nothing by then, then I'll make the inquiry.
Hubby works for state government so if need be we'll solicit some
help then.

there's a chance that you might actually get a permanent green card
stamp. my husband (former K1 fiance) and I attended his greendcard
interview in july 2003 - 1 month before our 2 year anniversary.
however, he did not get the stamp in his passport stamped (due to
pending security checks) until december 2003. because his date of
approval was actually december 2003 - AFTER our 2 year anniversary -
he got a permanent stamp.

what you can do is check out the letter informing you to go in for the
stamp. your AOS "approval date" is the date listed in that letter -
NOT the date of your initial interview. Also take a look at the right
hand side of the page where it says "Adj Class." If it is says that
your class is "IF1" you will be getting a permanent greencard. If it
says "CF1" you will be getting a conditional greencard.

I hope this helps and good luck.

K, this really got me confused....We had our interview March 2003 and our 2nd wedding anniversary was Oct2003 still hasn't get the approval (due to security checks).

So it means I will be getting a 10-yr GC if and when (only God knows) I'll get the approval?

Thanks!

The date of approval on the letter is the 5th of February, our 2 year
anniversary is 12th February. The letter says CF1.

yes, you should be getting a permanent card.

the key thing to understand (at least based my personal experience) is
that your approval date is NOT, NOT the date when you had your
interview. instead, your approval date is the "adjustment date" that
is listed on the letter you will eventually get from the BCIS
informing you to go in for your I55 (greencard) stamp.

if the adjustment date listed on this letter is after your 2 year
anniversary you should get a permanent stamp. if the date is before
your 2 year anniversary you will get a conditional stamp.

again, when you eventually get the letter simply look at the
adjustment date and then do the math in terms of your 2nd wedding
anniversary. to be even more specific also take a look at the right
hand side of the letter where it says "Adj Class." If it is says that
your class is "IF1" you will be getting a permanent greencard. If it
says "CF1" you will be getting a conditional greencard.

pretty straightforward. hope this helps.
