Default No approved K-1 visa petition within the last 2 years - question

Hello.
I just received an RFE on my K1 visa petition based on new IMBRA rules.
The RFE asks to complete and send back some questions on how my
fiancee and I met and on my criminal background which is no problem,
but in addition it mentions a new limitation: no approved K-1 visa
petition within the last 2 years (otherwise one must apply for a
waiver). Last year I filed a petition for another girl and that
petition has been approved here in the US and sent to the Consulate of
that girl's country but by that time we broke up and that girl never
went to her interview and of course never received a visa. Does that
still count as an approved K-1 visa petition? If yes then what can I
say in a waiver and what evidence in support of my waiver request I can
submit? The RFE mentions such evidence as police reports, death
certificates and news articles but of course they hardly seem
applicable in my case. Any help will be greatly appreciated. Thank
you.
