Default New York AOS Timeline.

Arrived in the US on a K-1 Visa, got married, and filed AOS paperwork
(Federal Plaza, New York City) on August 13th, 2002. All we're
received so far is a cash register receipt that our 3 postal money
orders were cashed: received this notification on August 25th, 2002.
Trying to figure out-:

1) When can we expect to hear from the INS and when can we expect our
AOS interview.

2) When do I get the EAD so I can start to work.

3) When can I get a NYS driver's licence. I tried to do this a number
of times,
but since my k-1 visa is expired (duh!!), the driver's licence people
aren't
able to issue me a licence.

Any advice would be much appreciated.

A cash register receipt from the NYC INS is ALL YOU WILL EVER GET FROM THEM in the form of a receipt. Do not lose that receipt. Do not misplace that receipt. Make photocopies of that receipt and keep them all safe. They are your only proof that you have any status here in the US once your K-1 is expired and until you get your EAD.

Question 1:

You will hear from NYC INS when they are ready to start processing your AOS for interview. The interview can be anywhere from 14 to 21 months after you submitted your petitions. You will receive fingerprint appointment notification close to the date of the AOS interview. Usually 3 months or so before the interview date. NYC INS "use to" send out AOS appointment letters within six months of applying and the appointment was usually for a year later. I.e., we received ours in March, 1999 for June, 2000.

Question 2:

EAD use to run approximately 60-65 days after submission. Today it can be anywhere from 60 to 120 days after submission. And those who have run over the 90 days tried going to Federal Plaza to get a temporary one issued on the 91st day and were turned away. You will be receiving an appointment letter in about a month of so.

Note: Can you tell that NYC INS is not user friendly?

Question3 :

No they will not issue you a New York State DL because you have no visual proof of legal status in the US. You might be able to get one once you have your EAD and your social security number. Did you apply for your SS card the moment you entered the US with your K-1 or have you not done that yet?

If you live in NYC or any of the 'burbs you are in luck that we have wonderful public transportation, bus, subway and trains.

I tried to call the INS and ask about my case. (AOS at NYC)
They said that it would be 24 months before the interview. It's so unfair for us whose living here in NYC and other parts that are covered by INS NYC. On the other offices, they can have their interview in 2-6 months after they filed it.

Not true. Try being in Pheonix were the wait is 3 years.

As for NYC you didn't call NYC but must have called the 1-800 number
because NYC does not have any published numbers to call. I know been
there and done that.

As for fairness, no it isn't. We started in 1998 and still have to
wait for Vermont to remove conditions. Applied in May of 2002 while
others who started after us are awaiting naturalization interviews.
So much for wanting new citizens to add to the voting cache.

If you're that mad, more to upstate New York or perhaps to New Jersey.
The Garden State is ahead of NYC in scheduling interviews.

I guess i was lucky...

I came in with a K1 visa in July, and resided in New Orleans (as my
wife was finishing up her Masters Degree). Married, and then applied
for AOS in New Orleans at the end of november 2001.... In january 2002
my wife and I moved to NYC, filed for change of address, (in the
meantime I had a EAD Card issued in New Orleans), and started working
at around the end of February...... As you've probably noticed my file
was moved to NYC from New Orleans, as we recieved the change of
address notice of action from the Vermont Service Center shortly after
we applied.

The luck, and amazement comes in now..... around March
we recive a letter from INS .... I was puzzled as I thought that it
could not possibly be an appointment of adjusting my status. Sure
enough, it was an appointment for fingerprinting for May 17, and then
another appointment for an interview exactly the subsequent month
(June 17 2002). As you can see only 7 and a half months elapsed from
the submittal of AOS to the interview.... To make matters even more
incredible (my interview went well, but was not approved right away,
because we were missing a W2, however we were assured that everything
was alright), I received the actual Green Card shortly after my
interview (a month later).

I was lucky...very lucky (it makes up for the fact that my K1 took one
year to be approved, thus i think that it balances everything out).
Another aspect was that the people in Federal Plaza were all very
pleasant, and demonstrated a great deal of availability towards my
wife and I. Who knows what happened.... maybe New Orleans did the bulk
of the work, so whenever the file was transfered to NYC the only thing
they had to do was to set up an appointent.... I really do not know
what happened.... I wish the best of luck to you, and do not despair
that much. I came in with the frame of mind that my AOS interview was
going to be scheduled a couple of years from now, thus I was very
relaxed about it, as long as I was with my wife, and I was working
(EAD card) I was happy.... everything else for me was just a plus....

Not only NYC, we waited 33 months for our AOS in Chicago,
recieved 3 EADs from them. The only one bright side of this-
permanent green card for 10 years, no need to remove conditions and
to deal with those people again.
