Hello,
My mum visited the US in 1984. She extended her stay using the I-539
form. Now she is planning on visiting again. The US consulate in India
needs the approval document issued in 1984. How do i go about resolving
this issue ? Are there any other options ?
Please advise.
Thanks,
Sanjay

Re: Need old I-539 approval document
Your mom can request it from the INS using either an FOIA request, or by
filing form I-824 to request a duplicate. Do be prepared for it to take a
very long time, though, a year or more would not be unusual.
There probably aren't many alternatives. The consulate wants to confirm
that she did not violate immigration law. The reasoning is that if she
overstayed 20 years ago, what is to keep her from overstaying now? So you
have to convince them that she didn't overstay. If you can think of
another way to convince them, that might be an option. But I can't really
think of anything but the old approval notice. An affidavit by her MIGHT
work, too, but it's rather unlikely in my mind.
