Need Help On DCF
Hi,
I am a US citizen married to a Canadian citizen living in canada for
last 4 years. can I do DCF in Toronto. Any help will be greate.

USCs resident in Canada must file their I-130 in the US, and an I-129f, should they decide to pursue the K3 path.

From sad experience, I can tell you that the consulates in Canada do NOT follow the regulations on filing of I-130's. However, NSC accepts I-130's from USC's resident in Canada.
Although this is, IMHO, a clear and unequivocal violation of law -- your remedies are simple -- none at all.

I was under the impression that filing a petition directly at a
consulate abroad was solely at the discretion of the consulate. Are
consulates required to process the petition for a resident USC? If so,
how does the consulate in Toronto get away with its violation of the
law?
