Default Nebraska: 240+ Days from NOA1 (I-129f) - Are we alone?

Hi All,

From what I'm reading here, I don't see anyone else with an I-129f through
Nebraska approaching anything like the length of time we've been waiting.
Am I mistaken? Are there others out there who - like us - received their
NOA1 from Nebraska over 240 days ago and have had no feedback since?

My fiancee has been talking to her congressman's BCIS liaison over the last
couple of weeks who in turn has been talking to the powers that be about our
case status. The best information she was able to give us a couple of weeks
ago was that there was a delay due to an audit, but that it had been
completed and our file was to be "expedited". She told us that our file was
all in order and that she'd expect us to hear some news in the next ten to
fourteen days. When my fiancee called her today to ask why we'd heard
nothing, she said that she'd heard the same but would chase it up and get
back to us before the end of the day...she didn't.

My fiancee called the BCIS enquiry number. She was told by someone there
that all that was known about the case was what was on "the file". There
turned out to be no notes at all on our file and we were told that even they
weren't able to contact Nebraska directly. Consequently, we are still none
the wiser as to our case's status.

I feel like there's something going on with the case that we're not being
told about, but neither of us have ever been in any kind of trouble in the
past so we can't imagine what it could be. Part of me thinks that they
haven't even opened our packet yet and will turn around in a couple of
months with an RFE. Am I just being paranoid? Should I stop being angry
and concerned and simply sit tight?

Any feedback from anyone in a similar situation would be most appreciated
just to know that we're not alone.

well, my fiance and I have not arrived at 240+ days yet, but have reached day 218 today. We were told by the Senator's office in January that our case is under security review, therefore we have a delay. We had to expect that, because my fiance (the US cititzen) has a criminal record, and we assume that this resulted in an IBIS hit and they are checking us out more carefully now.

In your case - what is an "audit"??? What could hold up your case for so long, if neither of you had any criminal issues in the past? Very strange, indeed.

I am afraid I cannot really offer you any advice, because I know that I, too, would go nuts. I am extremely nervous about our case because I simply do not know how long it will still take, and if we will get an approval in the end or not.

I can relate to your feelings very well, all I can say is "you are not alone". Try to keep on being patient, I guess it is the only thing you and I both can do.

The only thought I have: maybe you could try to contact your Senator and ask him to inquire about your case? Maybe he would come up with something better?? Or at least a better explanation about what is going on ...

Hang in there, and try to think positive. I know how hard this can be, because our situation is similar ....

Hi Monika, sorry to hear that you're a 200+er too.

Apparently I was one of those randomly selected by the FBI to open a file on
because I'd travelled to the US a lot. We were told that the BCIS had
requested my file from the FBI but the the FBI department that was dealing
with it were undergoing an audit and couldn't release my file until the
audit was complete. Sounded like a creative excuse to me. Maybe this is
the same as a security review?

I thought that the FBI check was part of the next step of the process when
Nebraska sends our file to the central BCIS offices? I could have got the
wrong end of the stick there, but if I'm right does this mean that our case
is going to be checked twice now, or is this instead?

Hi Andy,

selected by the FBI because you'd travelled to the US a lot?
Is that what you were told? Hm, interesting ... I have travelled to the US a lot, too, basically every year over the last 17 years!! So maybe they are looking into my travel history, just as well as into my fiance's criminal history????

You know, this is another question I am also wondering about ... once the petition gets approved, and sent on to the NVC - will they do the checks there all over again? I have no idea.

Well, we can't do much, but hope for good news soon.
As far as I have read here, most people do contact their congressperson as well as Senators. It seems to be helpful.

I wish you the best with your case, too, and please keep us informed here when something starts moving, okay?!

I've been to the U.S. 3 times since I met my fiancee.

November 2002 (for 2 weeks) , July 2003 (for 2 weeks) and December 2003 (for 2 weeks). I've also just booked another ticket to go out of easter for a 1 1/2 weeks for one last time before the final K-1 flight. Surely seeing our loved one and giving the USCIS concrete proof of our relationship shouldn't hinder us?

What do they expect us to do? File a K-1 and wait the damn thing out? Then deny it because we don't have enough "Evidence of relationship"!

Am I the only one who finds this a bit strange?

you are definitely not the only one who finds this strange. I find almost everything strange about this process, to be honest!
Exactly as you say ... they want all kinds of proof that our relationship is real, yet they might make it a problem for us that we travel to the States so often???

I have visited my fiance about 12 times over the last 6 years. Of course, we have only been engaged since last April, and filed the petition last July ... but if INS is wondering what I did all those times in the US - well, it was to be with my guy, to spend time with him, to get to know each other, and finally, to see if we are both ready for the commitment of marriage. How could a relationship be more real than this?? If they want more proof from us, at the end of all this waiting, then I'm gonna scream at them!!

Holy cow, that is way to long to be waiting. I thought Nebraska was slow in 2002 but not no more after reading this. I thought it was way to long for waiting 129 days. Thats nothing to going over 200.

I hope anyone who has reached the 200 or more days gets that approval soon. You guys have waited long enough.

I've probably travelled to the US over 20 times in the past 4 years.
I don't know if that's considered excessive or not, but I got the impression
that it was a random thing.

Additionally - I can't remember if I passed on this update or not, but:

My fiancee got a little more information yesterday.
According to the BCIS liaison, my background check failed so they are
performing
another.

Now this made me think of two things:
1) There is no reason for the background check to fail so could there be a
case of mistaken identity?
2) If the check failed, why would they then check again?
I mean, they don't usually need much reason to knock a case back!

Maybe I should see this as a positive thing though that it hasn't actually
been rejected at this point.

Which country are you from? Canada? Just thinking that because to travel to the US 20 times in 4 years is difficult to do for a European or Australian or so ... *gg*

Yeah, I guess you should see it positive - at least your case has not been denied, they check it again, so next time it should come out okay.

Possibly. Although I don't have a particularly common surname

I'm from the UK but I have a lot of friends in the US so it's made it a lot
cheaper for me to spend a lot of time in the US (although I've always
returned when I was supposed to). In fact, if I hadn't been going to a
party at one of my American friends', then I may never have met my fiancee
