Default name changes

Hi,

We were just married on the 27th of April after a long K1 process. I read this
site often and have learned a lot of useful information here. Thanks to everyone,
I'm not sure we would have made it without this group. We are very happy to
finally be together.

We are starting the AOS paperwork and one question has me a little worried. What
names to use on the INS forms?

Both my wife and step-son want to change their names and use my last name. I've been
reading things to try to understand what to do and the impression I have is this:

- She can just take my name based on the marriage certificate and we should simply
use the new name. No court proceeding is necessary. We use her new name on all
the documents from this point forward, including the I-485.

- My new step-son will need a court judgement to change his name and it is going
to take so long to get one that we should just continue using his old name on
all the documents we submit, until after he gets the green card. I think in
Illinois you need to be a resident 6 months to even apply for a name change. We
have not discussed this with his father yet either.

If it makes any difference, we were married in Tennessee, although we live a little
west of Chicago.

I have no experience with this and it all pretty confusing to me. If anyone has
experience with this, I would love to hear it before we make a mistake that we will
regret later.

You are correct on both counts: she can just start using your name, but he will
require a court judgment. You *might* be able to adopt him and accomplish this,
though I am not sure. Alvena
