Hi, so i am filling in the I-130 and I am using my married name, of course (besides in the space where it asks for any other names) but my "new" married name is not on the marriage certificate. My question is: since the I130 asks for proof of a name change, would the marriage certificate be proof that my name has changed purely for the fact that I am married. (My husbands surname is on their of course)
Does anyone have a definitive answer to this as it's confusing the hell out of us and if not, would you know where i could find a straight answer? e just want to submit the petition!
Thanks, guys.

The marriage certificate is proof of your right to use your husband's surname. You don't require anything else.

As for gender it appears that you are correct. This is a same sex couple ... both female ... as per their post on April 19th "So my wife and I are filling out the the I-130, I am the beneficiary (I live outside of the US in the UK) she, petitioner is a US citizen living in the US." A male normally does not assume the surname of his wife.

Looking back on 'his' posts, he is easily confused about the immigration process and going at things piecemeal rather than getting all the facts and learning the sequence of obtaining a CR-1. I understand sometimes or rather some people over think things and/or read into form questions and assume that every question must have an answer and don't accept that N/A Not Applicable or None are acceptable if the correct term is used, i.e. names of children is not N/A because it is applicable but the answer None is correct.
