My wife enter the u.s in 1998. However she enter without inspection.
(she is an undocumented immigrant, illigall) We have been married
almost 1 year now. We have a 6month old daughter. My wife has done
everything legal. SHe pays taxes through a tax id issued my irs. She
pays all our bills on time and has nver been in any touble with the
law. TOday i have filled out the following forms.
I-130
adjustment of status (can she adjust even though she is illigal.
I-765
finacial support info which i qualify to sponsor her.
and the heath examintaion form.
Which forms do i send in first and what can i do to help our situation
go quicker and easier. is it even possible for her to gain legal
permision to be here. any help would be appreciatied

You cannot file those forms because the Section 245i which would have allowed your undocumented spouse to adjust status has long since expired and there is little hope it will be resurrected in the near future. Why didn't you apply for her when the Section 245i was in effect? It only expired in April 2001 so you were married at the time and could have applied and paid the $1,000 fine and she might well have adjusted status by this time.

I think he said they only married one year ago (2003), though she did come here in 1998. That's probably why they didn't file before 245i expired.

1st thing you do is get a immigration lawyer before you file the first form.
You're on very slippery ground with her being illegal and what not, so
you're going to need reliable legal advice all the wya through the
proceedings before you even put down the first bit of ink.

I am amused how some people think sometimes. Your wife has done
everything illegal except that she broke the law! It's like saying "My
wife stole a car 3 years ago but she did everything legal!". I realize
you probably meant to say she has done everything legal since and except
for that little transgression in the past (which, of course, is a big
transgression) but your wording seems to me to be sugar coating it.
Might trick you and your friends but it shouldn't trick them.

I am amused how some people think sometimes. Your wife has done
everything illegal except that she broke the law! It's like saying "My
wife stole a car 3 years ago but she did everything legal!". I realize
you probably meant to say she has done everything legal since and except
for that little transgression in the past (which, of course, is a big
transgression) but your wording seems to me to be sugar coating it.

IMHO it's not rocket science (even with English as a second language) to
realize that "my wife committed a crime - but she didn't do anything
wrong" as disengenous! YMMV.

IMHO it's not rocket science (even with English as a second language) to
realize that "my wife committed a crime - but she didn't do anything
wrong" as disengenous! YMMV.
