Default My fiance's tourist visa was "withdrawn", should I mention this in my i-129f packet or at the k1 int

Hi,

I am about to send in the i-129f packet to apply for my fiance in
Chile to come to the United States. Last October my fiance flew to
the US on her tourist visa, and when she was at immigration they
discovered that she previously worked in the US for two weeks without
INS authorization and they told her that her tourist visa has been
"withdrawn", she was not officially deported, because she was not
allowed into the country in October. She has been in the US before on
her tourist visa(we lived together for 6 months)

So unfortately my fiance's tourist visa was "withdrawn", should I
mention this in my i-129f packet or at the k1 interview?
I keep reading people on here say not to keep any secrets, but if Im
supposed to mention anything- could this hurt my chances of getting
the visa?
Also, HOW do I mention it? There is no section on the i-129f for
comments. Or should I just wait until the k-1 interview (assuming i
get one)?

Sorry for all the questions but if a lawyer or someone informed is
reading this please respond. I just don't know what I would do
without my fiance.

Hi:

The K-1 petition doesn't ask. Technically, it is irrelevant. However, it will come up at the K-1 interview.

The "withdrawn" deals with her application for admission and former INS did a nice thing in allowing that.

I am curious how they discoved she worked for 2 weeks. Did she admit it? Or does the INS have instant access to tax records?

Get an attorney familiar with immigration and waivers. DO NOT LIE to the
BCIS or the Department of State. If denied, apply for a waiver. From what
I've read on this newsgroup, most waivers seem to be approved.

Hi,i'm in the same situation!!...I went to the U.S after Going on Holiday with
my Fiance(e) in Mexico back in sep 2002.
The INS told me i could not enter the U.S because i had spent too much time in
the U.S previously on other visits!...My Fiance(e) did not mention the incident
on the I-129f but i had to state on the application when i received it from
the US Embassy that i was denied entry!!(Be honest at all times)
So what does "withdrawn" mean? how does it effect us? I still don't know!
I do know that i am at the stage of waiting for my interveiw & medical date at
the (London) US Embassy.Everything has gone along smoothly so far but i am
wondering what will come up at the interveiw & if the withdrawn Entry will
effect my chance!...I'm gonna post a question in the NG,i'll keep you posted if
any news comes through!
By the way,my Fiance(e) in the US is from Chille originally,Beautiful people!!

It happened the same thing with me in December of 2000. I stayed in
the US for 11 months and had extension of stay granted by INS, but
they didn't let me return because I was working as a nanny.
I'm engaged to an american citizen, my boyfriend at that time. We're
just waiting for his divorce so we can send the petition.
I'm also worried that this can cause me problems.
Some people told me I shouldn't worry, if I tell the truth in the
forms and at the interview.
