I'm not sure where to start. I live in uk my boyfriend in usa. I have 2 kids age 14 and 15.
What is best way for me to move over to him. Get married in uk or usa. How long does it take. Also is it easy to get visa for kids and sort out schools .

It doesn't matter where the marriage takes place, as long as it's a legal marriage.

You will need written permission from the kids father (or a court order) to be able to bring them with you to the ISA permanently.

There are 2 paths via marriage to a USC. A K-1 fiance visa, or a CR-1 spouse visa. Our Wiki Guide has a chart outlining both paths, so you can compare.

Either way, your fiance will have to complete an Affidavit of Support for you and the kids. Hopefully he earns enough, has enough in assets, or can find a joint sponsor if necessary.

The first big questions are:

1. Have you and your bf met in person?
2. Are you two ready for marriage?
3. Can you get the required permission from the kids' father?
4. The visa process can take a year. Would you rather spend that year apart as an engaged couple or a married couple? (You are allowed to visit each other during the process).
5. Does your fiance have the required account of income/ assets for a family of at least 4 (assuming no other children at home)?

The following gives you info as to how to apply for a spouse visa for US.

The process takes about 8 to 12 months, whether you go the fiance route (apply for fiance visa and then change status once in the US) or get married somewhere, and then you apply from the UK for a spouse visa).

Your fiance/husband will need to sponsor you and the children so need to have income around $31K (4 persons family). Joint sponsors can be used.

One further note to Rene's excellent post, you have teenage children, the oldest of which is 15. The marriage must have occurred before our child turns 18. The age-out provision will cover them if your adjustment of status draws out past their 21st birthdays. This happening is a very very very long shot but thought you should be aware of it.

Also note that for the USC to come to the UK to marry you is not as simple as entering the US on an ESTA/VWP and going to the court house, getting a marriage license and getting married. In the UK, he will need a special visa to enter the UK to marry you and there is a wait time of a month or so before the marriage can take place. You can marry anywhere in the world that US recognizes their marriages to be legal.

PS Do NOT marry until you have obtained permission from the children's father(s) for them to be taken outside of the UK to live.

Well, that depends ...

If the OP is certain that this is the person that she wants to marry then she should just go ahead and get married - but with the understanding that, unless and until she gets permission from either her children's father or a court that allows here to take the children to the US with her, it will not be possible for all of them to live together in the US as a family.
