In fact the OP said that they had asked their attorney about that exact point, and she reported bring told that though married they could still file for a fiancée visa, so she was actually very clear about what she claimed to have been told.

Perhaps -- its just that I've seen way to many "clear" but wrong descriptions in my life. Absent seeing the paperwork or being a party to the conversations, I don't really trust what I am told. I learned a long time ago that that path is dangerous. "Trust but verify." Ronald Reagan.

If someone comes to me at work with a verbal summary or a summary memo, I always want to see the source documentation as the nuances of the interaction of many factors can require choosing one of several courses of action, and sometimes change the outcome/ decision by 180°.
