Marrying an undocumented Mexican woman

Default Marrying an undocumented Mexican woman

If I marry an undocumented Mexican woman in the U.S. what will I have to do to make
her legal in this country ?

How long will this process take ?

Can I take her on a cruise around the world and take her back to the U.S. before she
gets her legal status ?

Marriage to a US citizen will not give an undocumented immigrant the ability to
become legal. She will not be able to adjust status, because you can only adjust
status if you make a legal entry into the US. Seek the advice of an immigration

Thanks for the advice.

Since the U.S. officials don't check people on the way out to Mexico, can she just
cross the border back into Mexico and return to the U.S. to marry me ?

Or should I go with her to Mexico and marry her over there ?

Would it make any difference if she entered the U.S. legally the first time (more
than 10 years ago) but just didn't go back when she was supposed to ?

What about if she's going to have a baby about 9 months from now ?

Well, she could be banned from the US for overstaying.

The baby would change nothing until he/she reaches 21.

If she entered the US legally - then yes, she can get married and adjust status from
the US - and the overstay would be forgiven. But since she overstayed she cannot
leave the US until she receives her Green Card - to do so who incur a 10 year ban
from reentry. Being pregnant or having a child in the US will not change anything.
Illegal work is also forgiven spouses of US citizens, but not the use of illegal
document to work. See this site

tourist adjustment and follow the directions. And remember - she is not eligible to
get Advance Parole and cannot leave the US until she has a Green Card - although she
will have legal status again as soon as you file the AOS paperwork. Also - try
posting as alt.visa.us.marriage-based for lots of folks going through this process.

You will not be able to keep her here.

There is nothing you can do.

There was an ill timed and unneccessary amnesty called 245(i), but this has since
expired. In reality it did more harm than good and increased the waiting time for
intending immigrants who waited their time for a visa number.

That would be illegal, and if you are caught, both you and her would be in trouble.

If she is caught, yes.

Well, if the baby is born here in the US, the baby is a US citizen, but that will not
help the mother until the baby turns 21.
