Marrying on a tourist visa if we're living in another country

I've searched Google but haven't found this is situation:
I'm an American living in Europe. My European girlfriend and I wish to get married in
the US and then return to our current country of residence in Europe. Can she do this
on a tourist visa? I understand the normal complications of this, but since we do not
wish to stay in the US we really will be tourists! We won't be moving to the US for
several years, which would give us plenty of time to file the paperwork and obtain
the proper visas required for her to move to the US.

Yes, there is no law against it. However do check the marriage laws in the state
where you plan to marry, as these do vary by state. Find a net is a summary here:

I might add that IF she does not have a tourist visa at this time, and you apply
stating that this is the reason for obtaining it, she may not receive the visa unless
you can show evidence that you will be returning to live in Europe. However I think
most Europeans can travel on visa waiver instead of tourist visa:

I called the office in my state that handles the marriage licenses (Arizona) and they
said they only require ID to verify the couple is over the age of 18. They don't
require a passport, visa, birth certificate, or anything else.

She could visit US on a tourist visa or visa waiver program.
If her intention was to get married, she should not be entering on tourist visa or
visa waiver program. If INS questions her intentions in the future when you both
decide to come back, that may raise issues.
If she comes on a K-1 visa and goes back to Europe, the AOS process could be filed
any time in the future.
If you both are planning on eventually living in the US, you may not to want to take
chances with the INS.
