Married in US on K-1 thinking on moving back to England
 
Hey everyone :-)
I have a question that someone can hopefully help me out on. My
husband is British and I am a US citizen. He came here to the US on a
K-1 visa in Sept. 2003 and we were married in October. We are now
preparing to do his AOS but i have been thinking on having us move
back to England sometime in the next year or two. How hard is this for
us to do? Is it a big process for us to get permission for me to live
and work in England? Should we bother applying for his AOS if we want
to move back to England? Thanks for your help, this board has been a
HUGE help for us in the past throughout our K-1 process.

Moving to England is fairly easy, in fact far easier than getting in to the US. When my wife and I were married, we applied for a spousal visa for her at the British Embassy in NYC. As we did it in person, it was a one day visit and we left with the visa in her passport. Your only worry will be proving financial support and accomodation. Hi:

He is now accumulating "unlawful presence" for 212(a)(9) 3/10 year bars to return. FILING of AOS will stop that "clock."

Also, you seem to be speculating a bit. You may or you may not move to the UK. There is nothing wrong with obtaining LPR status, giving it up, and then applying again. Also, with some care, it might be possible for him to maintain LPR status during a long sojourn in the UK.

A lot of things to consider. A consultation with an experienced immigration attorney might be in order.
