Married only second half year, tax return as single or married?

Default Married only second half year, tax return as single or married?

question, we married for almost two years. right now I need to collect joint tax return forms to remove conditions on GC
Problem was in the first married year, we filed tax return as single since we thought we only married the second half of the year. We did not think it over.
Is it right? If it is wrong, how to make it up?
We filed joint tax return in the following years.

You need to be absolutely clear... did you file as "married, filing single" or did you file as "single, not married"?

If you filed as "married, filing single" that is perfectly okay. If you filed as "single, not married", then you should probably file an amended return.

Either way... for immigration purposes, you need to demonstrate that you filed a return... and, from what you've written, you did file a return (even if it was wrong).

If you were married during any part of a tax year, you file "married". That can either be "married filing jointly", or "married filing separately", but it should not be "single".

I believe it would be in your best interest to do an amended return for that year.
