Default Married to a girl, got her GC and now she want to take my money - HELP!

I got married to a girl from Europe 4 years ago. Brought her over here on a
F1 student visa. She was on F1 for 4 years. I got my US citizenship and
filed for her. She got her green card this summer. It is good for 10 years.
(I guess she don't have to remove condition after 2 years!?) Now she has a
new boyfriend (she doesn't know that I know about) and wants to divorce me.
Besides divorcing, she wants to take half of my savings (I have earned this
money while I was married to her, but I earned it alone and supported her
thru collage --$100/foreign student unit). She has an 8 year old from her
previous marriage. She is about to hire a lawyer and seek for alimony
support from me and take half of my savings. Is there any way that I can
void my marriage? Is there a better way out ? (I respect the child, he has a
future here in the US, not much in Romania. Doesn't even remember his old
country.). Can/should I call INS and explain the situation? Any easy way out
for me without spending all my savings + years of alimony? What should I do?

As far as INS goes, I don't think there is anything you can do, she has a permanant Green Card, also, marriages do end, why would you want to try and ruin her future, just because the marriage to you has not worked out.

As far as your savings are concerned, Divorce laws vary from state to state, I would contact a Divorce Lawyer.

She has a conditional green card valid for two years but she can have a
permanent one even without your agreement if she can prove that her marriage
was a guenuine one. You should be able to prove that she has a new
boyfriend, and contact the INS office which will have juridiction over her
removal condition case. Then file for divorce, I believe she'll have some
money even if that won't be half of your savings. You won't have to pay
alimony support especially if the child stays in the US with you (in that
case, you may even file to have her to pay alimony support).
First step : Prove to INS that her marriage attend wasn't love but was
something between money and breaking immigration laws (ie thanks to the
relation she has with her new boyfriend), then she doesn't find another
status, she'll deported after the two years of conditional residency)

PS : Notice that the 2 years start when she becam a permanent resident and
not when she actually recieved her plastic green card.

If the marriage was more than two years old on the day that she became a
permanent resident, then she *should* have received permanent resident
status without conditions, and obtained a PR card valid for 10 years.

You said that you have been married for 4 years, and she just got the "green
card" this summer. That means that she properly received the PR card
without conditions.

If the marriage had been less than two years old on that day, she would have
received conditional permanent resident status, for which the condition must
be removed about two years after PR status was granted.

If I were you I would not bother trying to annull the marriage. You could
file a report with INS. However, the burden of proof for fraud would be
very high, and INS is so overwhelmed with trying to deport criminals, and
catch terrorists, and so forth, that INS may not pursue this kind of case.

In California or another community property status, she is entitled to one
half of the income that came into the marriage between the marriage date and
the divorce date. If you are in a pension plan that would have covered her,
you will probably have to compensate her for the value of what she lost.

I'm not sure about this, but it's possible that if you document all the
money you paid supporting her through school, she may not be able to get one
half of all your *present* savings, because that may be less than half of
the income that came into the marriage. I'm not sure about that -- you
really need to get a good civil attorney. It will be probably be difficult
for her to get alimony in California, because she is able-bodied and
educated, and she can work.

If she goes on welfare, the government may be able to come after you for
reimbursement under the terms of the I-864 Affidavit of Support, even if you
are divorced.

http://www.divorcenet.com has alot of good info. Divorce settlements vary
by state.

Also, alimony typically lasts for half the duration of the marriage, and are
most times not awarded in short marriages.

Lots of factors come into play in a divorce. The best thing would be to get
advice from an attorney.

This is just my opinion, but unless you specifically had an agreement with
her to exchange money for a green card, there is no fraud involved.
Regardless of whether she has a boyfriend or not, or cheated on you with
every man there was, the marriage was a real, valid marriage. I know (from
experience myself) that you may feel hurt and wronged, but trying to ruin
someone else's life is not the way to heal your wounds.

Get a lawyer, hide your savings and move on with your life.
