Marriage to a US citizen - need advice

Hi,
Here's the situation:
- Canadian citizen.
- was on several TNs before getting an H1b in Sept.
- had a dispute over owed money by employer and quit mid Oct.
- didn't get another job.
- got engaged New Year's eve and now want get married.
Questions:
1. am considered "out of status" according to a lawyer - can I still
marry, file I-130/485/etc and remain in the country?
2. If I file I-130/485/etc, can I also get the EAD that day if I file
in person? If not, how long will it take to get the EAD?
3. If we don't get married right away, can I get a TN if I get another
job? If I get a TN, can I still marry a few months later?
4. How much should the I-130/485/etc. filing cost if I go through a
lawyer?

Yes. Read the instructions on the I-485 form to be sure, and note
exceptions for spouse of US citizen.

It depends on the INS office, some issue the same day, others take over
90 days.
I do not know the answers to your other two questions.
