Default Marriage in Jamaica: H1B to US Citizen

I am currently on a H1B visa and my fiancée (US citizen) and I would
like to have a weddingmoon in Jamaica. If we get married in Jamaica,
will this affect our I130 Petition? Is there a requirement that the
actual marriage take place in the US?

No. An I-130 is filed no matter where the wedding takes place.
If, however, you want to file I-129F to get a K-3, the K-3 interview
MUST take place where the marriage did. No, this doesn't mean the
consulate in the country you married in has to permit the interview
there. It is limits you to getting married only in places that will
interview you for the K-3.

I would disagree. I am no lawyer but also on H1-B.

You could just marry in Jamaica and then come back to the US as H1-B and then only file your I-485 Adjustment of Status and your spouse would file a I-130 Petition for Alien Relative.

What actually do you disagree with in my post?
I didn't mean he needed a K-3.
I meant if filing an I-130 for an immigration visa or AOS, it doesn't
matter if you get married in a third country. However, if you want a
K-3, then the marriage would have to take place in a country where the
consulate would process your K-3 as K-3 requires the interview in the
country of marriage.

No problem. H-1Bs have dual intent so you can re-enter intending to file for
AOS without problems. Although I got married in the US I immediately left
for honeymoon to Tobago and filed for AOS after returning. Since I was H-1B
it was a non-issue.
