Default Marriage Based AOS - some questions

Hi there,

I am currently on an L1 and married to a USC - we are getting ready to submit our package.

I have a few questions:

1) My wife may just be under the 125% poverty line required. I will however still be working for the same company after the AOS. Is it better to include my income on the form as part of the household income or rather use a joint sponsor?

2) When submitting the i-130 and i-485, should I supply separate checks/money orders or can I combine them?

I don't think it matters to USCIS either way. Probably easier to use your combined income on the I-864 and do less paperwork rather than use a joint sponsor. The Officer has the power to not accept your income though, so not a bad idea to line up the joint sponsor anyway, just in case.

You can write just one check.

I had one more question which I forgot to ask -

My L1 visa expires end of 2009. What happens if the entire process of AOS is not finished by then?

If you have your EAD by then, you can continue working. If you have AP, you can travel outside the USA. You are in-status even if your L1 expires, because you have a pending AOS.
