Marriage based AOS filed, got a few questions

I-797s arrived Monday 15th August and Biometrics notification arrived Thursday 18th August for an appointment on Tuesday 6th September. How long after biometrics should I expect to wait for EAD? I have a new job lined up but cannot start working until I receive my EAD.

Timeline so far:

July 14th - sent packet, signed for on July 15th at Chicago Lockbox.
August 10th - received notification via email and I-797s a few days later BUT receipt dated on letters was July 18th. Checks were cashed on August 11th.
August 18th - Biometrics notification for Sept 6th.

It takes about 90 days from filing AOS to getting EAD in hand, regardless of when your biometrics are done. So you should have your EAD by around mid-October.

By regulation, there is a 90 day clock for issuance of an EAD. If you do not get an EAD [or a denial] within that 90 days, you can go into the local District Office to get an interim EAD. The 90 day clock stops once they send out the biometrics request and does not restart until you give them.

BTW, it is common practice for people to go into the "ASC" to give biometrics before the appointed date. If not too busy, the ASC will process the biometrics. So, don't go in when they first open the doors. The worst thing that can happen is they refuse to do them.

BTW, on the interim EAD, the local office no longer actually issues them, they call the appropriate Service Center to get their ass in gear to process for the interim -- they end up giving the normal one.

Thanks. What would be grounds for EAD denial? Could they deny on the fact I already have a work visa?

Perhaps an incorrectly filed AOS might be grounds for an EAD denial, but I've never heard of an EAD getting denied when it's in conjunction with AOS.

Could they deny on the fact I already have a work visa?
