Hello,
I was recently informed that my application for green card through
marriage was denied, due to not appearing for fingerprint appointment.
Here is my time line:
1) Got married in April of 2004
2) Filed I-485 and I-130 on May 20th 2004 in Indianapolis
3) Transferred my case to Chicago in Jan 2005
4) Had interview in Chicago in October 2005
5) Did NOT receive a letter to appear for fingerprinting on December
20th, 2005
6) Moved to Florida in April 2006
7) Was notified that case was closed on May 1st 2006
8) Filed motion to reopen the case on May15th 2006
9) Follow up letter was send on Aug14th 2006
Since August 14th, I haven't heard anything from INS. I wanted to check
what are my options at this point. More particularly:
1) Is there any way for me to find out if the decision for reopening of
a case has been made? How long does it usually take for INS to make a
decision on such motion?
2) Can I reapply immediately? Will reapplying have any effect on motion
to reopen the case? What is the current time line for I495, I-130
applications in Florida?
3) If anything happens to my marriage in the meantime, would I still be
eligible to apply for green card (considering my I been married for
over 2 years now)?
4) Does anyone know any good lawyers in Chicago who would be able to
help to reopen the case, or in Florida to reapply?
Any help would be greatly appreciated!!!

Go to this link: http://britishexpats.com/forum/searc...earchid=723457. Scroll through, and read the posts started by "grouchy" with the words "motion to reopen" in the title. I think those will be a good starting point for you to read.
Best Wishes,
Rene

Rene,
I forgot to thank you for your post. The link has been very helpful.
After the review here and spending money on a lawyer I think I am
pretty as to where my case stands. Hopefully this will get resolved
some time in the next year.
Thanks again.
