I always found "legal separation" to be an amusing term... as though a couple could be illegally separated! Once two people stop living together, even if they remain married, they're separated!

I am also amused with the use of 'legally' as an adjective in many contexts. In this context the alternative is not "illegally separated", informally separated might be the better term, because there is a legal process to formalize a separation while remaining married. Alternatively a couple can, as you say, simply stop living together without going through any legal process.

In this case, the OP simply stated that she and her husband have agreed to separate. She didn't say whether or not they would go through the legal process of separation, nor did she tell us if they would be taking up separate residences although that is the usual thing to do whether the separation is legal or informal. Usual, but not always and not necessarily.

There is a need for them if the DO questions the validity of the marriage that was the basis for the green card. And that question might well come up at the N-400 Interview.
