K3 Visa under the 2 years rule of J1 Visa

Default K3 Visa under the 2 years rule of J1 Visa

Hello everybody,

I am a peruvian medical doctor. I was in US attending a short training
course under J1 visa for 3 months. I got married with american citizen
there being under J1 status. I came to my home country in order to
comply the 2 years requirement, just I complied 1 year. My husband
applied for I-130 and then for I-129 in order to get K3 Visa for me.
The petition was approved last January.

Now the American Consulate here in Lima scheduled an interview for K3
Visa. They have asked me a list of requirements, which I already have
most of them.

Because I don't comply the 2 years rule yet, I am thinking they could
denied me the K3 visa.

Another question that I have is where can I get the police records
from mexico, because I lived there for 9 years .


Please if you have some information regarding this , let me know

I can't help specifically with the police report; possibly you could contact
the Mexican consulate for help with that?

On the 2 year HRR, if you are subject to that you must wait out the two
years or get a waiver. I think getting the waiver will take as long as
waiting out the year. I expect the K-3 would be denied because of this -
perhaps they will extend the petion for you to get it in a year's time.

Thanks Andy for your reply,

Our guessing is almost the same, that the K3 Visa would be denied. I
am thinking to ask to American Embassy officers here in Lima, to
schedule again the interview next time , when th 2 years HRR will be
completed. I hope I can ask for that.

Regarding the Police Certificate from Mexico, I already asked to
Mexican Embassy in Lima, and they told me they can't help me with
this. I was doing research on the internet and I found this
information:

POLICE CERTIFICATES
Police certificates are required from every visa applicant aged 16
years or over for each locality of the country of
the applicant’s nationality or current residence where the
applicant has resided for at least six months since
attaining the age of sixteen. Police certificates are also required
from all other countries where the applicant has
resided for at least one year. Generally, application for such
certificates should be made directly to police
authorities in the district in which you resided. If you have any
questions about where or how to apply for police
certificates in other countries, you may communicate directly with the
U.S. consular office processing your visa
applications.
Do not attempt to obtain police certificates covering residence in any
of the following countries, as they are not
available:
Afghanistan*
Angola*
Azerbaijan*
Bangladesh*
Bulgaria*
Cambodia
Chad
Colombia*
Costa Rica*
Equatorial Guinea*
Ghana
Guatemala*
Haiti*
Honduras*

From what I understand, K3 visa is NOT an immigrant visa, hence 2y FRR does not prevent getting it.
