Hi,
My Name is Bhavesh Shah and I am a recent paticipent in the K-3 Visa process. I have been reading all the posts here with a great interest and have been able to learn and understand the k-3 process.

Let me explain my situation. I am a US citizen and I recently marriad to an beautiful Indian lady (in december). I have already filled I-130 and I-29F(1 NOA Feb 2003) for my wife and now just waiting for the 2 NOA for my I-29F.

Now, I have few questions if anyone can answer it.
1. I have seen posts on this site for getting a work permit from INS but I want to know What is the Process (if any) for a K-3 visa holder if she wants to attend college here?
2. I would like to know bit more about the Provisional file that I have read on this site. What is it?

Any information will be appriciated....

Hi:

A K-3 can attend school. Other than the B-2 classficiation, there is generally no prohibition of a letter non-immigrant from attending school as long as it doesn't violate the principal purpose of the entry into the United States.

No special permission is needed.

This happens all the time. For example, lets say an engineer is the US working on an H-1b petition, her H-4 spouse can attend college, and the H-4 children can attend school [even public school -- although some districts get confused about that]. The H-1b can even take a class or two while they are working.

I want to make crystal clear that B-2 visitors can NOT attend school. And if they attend public elementry or secondary schools, really bad things can kick in.

It is good to know that she can attend school or college whenever she comes here.

I know it is still long way for me to get approval.
