K3 visa question

Default K3 visa question

Hello,

My husband is applying for a k3 visa and I-130. (I am USC and we were married in the UK) Am I right in thinking we can travel to the US once the k3 visa is approved? If so, will he be able to work in the US? Also, our children are USCs, do I need to file any paperwork for them?

Are you the US citizen living in the UK with leave to remain

Yes, I have leave to remain in UK.

In there a reason you cannot do DCF at the London Embassy

Tina,

Your husband does not apply for I-130 - you do.

If your husband enters the USA using a K3 visa he will be able to work after he obtains both employment authorization from the USCIS and a social security card from the SSA.
